Durban prosecutor nabbed for allegedly freeing foreigners arrested for serious crimes

0

A Durban prosecutor has been arrested for allegedly freeing foreigners involved in serious crimes by fraudulently charging them with lesser charges then allow them to pay admission of guilt fines before letting them go.

The prosecutor was able to get the accused persons off the hook with lesser charges by misleading his superiors about the facts of the cases.

Prosecutor Ntokozo Mzulwini, 33, based at the Durban Magistrate’s Court, was arrested at his place of employment last week.

He appeared before magistrate Ashwin Singh on December 9 and the State was led by prosecutor Calvin Govender, who did not oppose bail.

Singh set bail at R3 000 with conditions.

The State alleged that Mzulwini would arrange for the foreigners in question to pay admission of guilt fines by misrepresenting to his supervisor that the respective charges related to contraventions of the Refugees Act.

In so doing, the supervisor would be induced into authorising and signing off on admission of guilt fines, yet Mzulwini knew that the charges were contraventions of the Immigration Act, which does not allow for admission of guilt fines.

It has been alleged that on two occasions Mzulwini’s conduct was in breach of Section 3 of the Prevention and Combating of Corrupt Activities Act of 2004.

In those instances, Mzulwini, instead of pressing ahead with charges relating to housebreaking and being in possession of stolen goods, enabled the accused persons to get away with fines.

Mzulwini was also accused of withdrawing a drunk driving charge against an accused person when he was given instructions to proceed with the matter.

One of his superiors queried his handling of the said matters. It eventually led to his arrest and he has since been charged with fraud, defeating and obstructing justice and contravening the Prevention and Combating of Corrupt Activities Act.

One of Mzulwini’s bail conditions was that he did not communicate with State witnesses. The matter was adjourned to next month.

“It is alleged the child fell into the pool and was found in the water before CPR was started,” said Jamieson.

Suspects caught digging grave – leave behind bag of muti, panga and spade after fleeing

Imagine you have laid your loved one to rest but you get a phone call from the police that their grave has been dug up and there are body parts missing. It’s now scary with these muti doers who are doing all these rituals just to get some perks in life.

Police in Mpumalanga has called on anyone with information to come forward after a grave was dug by suspects who were trying to exhume the body of a man who was buried a few weeks ago.

According to Brigadier Selvy Mohlala, the suspects were caught by residents at the Jerusalem graveyard in Masoyi, outside White River, in the early hours of Wednesday morning.

“It is alleged that some members of the community were going to the grave in preparation for a funeral when they saw two people who then fled upon their arrival,” explained Brigadier Mohlala on Thursday.

“Police at Masoyi were informed about the incident and upon arrival at the scene, they discovered that the suspects left a panga, a spade as well as a bag with some items which look like muti inside.

“Upon closer observation, the grave of a man who was buried on 23 November 2022 at the age of 19 was dug but the suspects failed to bring the body to the surface. His family was then summoned and they are in the process to determine whether his body parts are complete.”

A case of a violation of a corpse has been opened and is under investigation.

Police cannot rule out the possibility that the act could be related to practices of a certain cult, however, more details will unfold as the investigation progresses.

No one has been arrested so far.

The Provincial Commissioner of the Saps in Mpumalanga, Lieutenant-General Semakaleng Daphney Manamela, condemned the incident and labeled the act as an indication of moral decay in the society.

Desmond Dube owes SARS R1.4 million in taxes

0

Desmond Dube, a media personality and clientele Life Ambassador is at loggerheads with the South African Revenue Services (SARS). He might be forced to sell off his assets in order to settle over R1.4 million that he is owing in form of taxes

It was rumored that the TV personality Desmond Dube was homeless, he later cleared those rumors. This case seems not to be the first case against him. City Press reported that Dube is facing execution to sell off his assets to comply with SARS.

“Desmond Dube could face a warrant of execution to sell his assets should he fail to comply with a final letter of demand issued to him by Sars for him to settle over R1.4 million in unpaid taxes” wrote City Press

Reportedly, Dube was served with the papers last week to settle an amount of over R1.4 million rand in unpaid taxes. The letter also highlighted that should Dube fail to work with the SARS, he could end up with a warrant of execution which will also allow SARS to sell off his assets in order to settle his R1 432 675.61 debt.

“According to the records of Sars, you have failed to pay your tax debt for one or more tax years and tax periods… you are requested to make full payment within 10 days from the date of this letter of demand.”  wrote City Press

The letter sent to Dube also has a time frame as it also highlighted that the How To Ruin Christmas actor has exactly ten business days to comply with the taxman in order to settle his debts.

“You may within 10 business days from the date of this letter of demand apply for any of the following remedies: payment installments where you are unable to pay the full amount, suspension of the debt where you intend to submit or have submitted a formal dispute, compromise of a portion of the tax where this will provide a higher return to the fiscus than liquidation, sequestration, or other collection measures.”  wrote City Press

Reportedly, Dube has been provided with strict and stringent instructions which will see him having to sell out some of his assets if not all, in order to settle his unpaid taxes.

“Failure to make full payment or use the above remedies may result in the following actions and possibly others: Sars may appoint any third party who presently or in the future will owe you money or hold money for you to settle your tax debt with this money. A civil judgment being entered against you in which case a warrant of execution may be issued for the Sheriff of the court to attach and sell your assets.”

It is also reported that Dube has rubbished the claims, while providing that the case is remedial and currently is going through legal channels.

“I am not sure who your source is, but the numbers are totally incorrect. The case is remedial and going through the legal process.” said Desmond Dube (City Press)
